The DRAFT Clallam County Code Chapter 41.20 is posted for your review and comment. The draft is not yet complete and is still undergoing revisions.
The ordinance contains some new sections such as Marine Recovery Area requirements, reporting septic system status at the time of property transfer, and enforcement with civil penalties. The term "(Reserved)" means that this section of the ordinance will need to be developed and adopted into Chapter 41.20 at a later date. We are very interested in your review on sections of the draft that address recommendations in the On-site Management plan such as the Local Management Plan and Regulation (section 41.20.170), Report of System Status Required at Time of Transfer of Ownership (section 41.20.190), and Enforcement (section 41.20.240, 250, 260, 270).
We are looking for guidance on how to structure the Septic Maintenance Provider designation.
Should we, for example, have two levels of service providers:
Level A – Only conventional gravity systems, performs maintenance inspections and simple repairs to the septic tank (i.e. risers, baffle replacement need for pumping)
Level B – All on-site septic systems - performs maintenance inspections and simple repairs and adjustments to all system components including pumps, floats, electronics, etc., in addition to the septic tank and pump chamber (i.e. risers, baffle replacement, screen cleaning, and need for pumping).
We are continuing to research septic system nitrate reduction performance and so section 41.20.170, Best Management Practices within Designated Critical Aquifer Recharge Areas, is reserved and will need to be addressed at some future date.
Please invite other interested parties to review and comment on the draft. We will be accepting comments through August 31, 2007.
At this point, we are still in the informal review process, and no date has been set for formal review and call for hearing by the Clallam County Board of Health. That process should take place later this fall. We are seeking informal comments on the draft ordinance at this time.
